1. Program Overview
Deductify operates a membership-based platform that provides deductible payment benefits and other auto-related services. Deductify is not an insurance company and does not replace or modify any insurance policy.
Affiliates may earn commissions by referring new paying members to Deductify using approved referral links, codes, or tracking methods provided by Deductify.
2. Eligibility
Affiliates must be at least 18 years old and legally able to enter into binding contracts. Affiliates may include individuals, businesses, licensed insurance professionals, body shops, content creators, and other partners approved by Deductify.
Deductify reserves the right to accept or reject any affiliate application at its sole discretion.
3. Commission Structure
Affiliate commissions are calculated based on gross membership fees paid by referred members.
Commission rates are determined by the affiliate tier in effect at the time of the referral and may be adjusted by Deductify with prior notice.
Commissions apply only to successfully processed and paid memberships. Deductify does not pay commissions on free access tiers, promotional trials, or non-revenue accounts.
4. Payouts
Affiliate payouts are issued on the first business day of each month and are based on gross revenue collected in the prior month.
A minimum payout threshold of $20 must be reached before commissions are paid. Any unpaid commissions below the threshold will roll over to the following month.
Affiliates are responsible for providing accurate payment and tax information. Deductify is not responsible for delays caused by incorrect or incomplete information.
5. Refunds, Chargebacks, and Cancellations
Affiliate commissions are calculated on gross membership fees. However, Deductify reserves the right to withhold or claw back commissions associated with fraudulent transactions, chargebacks, or abuse of the platform.
Normal member cancellations do not automatically invalidate earned commissions unless fraud or misrepresentation is involved.
6. Termination of Affiliate Relationship
Affiliates may terminate their participation in the program at any time by providing written notice to Deductify.
If an affiliate relationship ends at the affiliate's request, Deductify will pay all accrued and unpaid commissions earned up to the termination date, subject to this Agreement.
Deductify reserves the right to immediately terminate an affiliate relationship for fraud, misrepresentation, deceptive marketing practices, or violation of these Terms. In cases of fraud, unpaid commissions may be forfeited.
7. Marketing and Promotional Guidelines
Affiliates must represent Deductify accurately, transparently, and ethically.
- Affiliates must clearly state that Deductify is not insurance and does not replace an auto insurance policy.
- Affiliates must not use misleading, deceptive, or exaggerated claims.
- Affiliates must avoid language that can cause consumer confusion, including but not limited to the words "covered," "claim," or "insurance replacement."
- Affiliates may not imply guaranteed savings, guaranteed approvals, or guaranteed payouts.
8. Required Disclosures
Affiliates, especially those with insurance backgrounds or licenses, must clearly disclose their affiliate relationship and comply with all applicable advertising, licensing, and disclosure requirements.
Deductify may provide recommended disclosure language. Use of such language is strongly encouraged to ensure compliance and consumer clarity.
9. Branding and Creative Use
Affiliates must use Deductify-approved logos, branding, and marketing assets when available.
Affiliates retain editorial control over their content, provided all representations remain accurate and compliant with this Agreement.
Deductify reserves the right to request edits or removal of any content that is misleading, inaccurate, or damaging to the brand.
10. Fraud and Abuse
Deductify maintains internal fraud detection processes to protect the platform.
Affiliates may not engage in self-referrals, fake accounts, misleading promotions, or any activity intended to manipulate commissions or platform metrics. Any suspected fraud may result in immediate termination and forfeiture of commissions.
11. No Authority or Agency
Affiliates are independent contractors. Nothing in this Agreement creates an agency, partnership, joint venture, or employment relationship.
Affiliates have no authority to bind Deductify, alter member agreements, or make promises on Deductify's behalf.
12. Limitation of Liability
Deductify shall not be liable for indirect, incidental, special, or consequential damages arising from participation in the Affiliate Program.
Deductify makes no guarantees regarding income, conversion rates, or performance.
13. Modification of Terms
Deductify may update or modify these Terms at any time. Continued participation in the Affiliate Program constitutes acceptance of updated Terms.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
15. Acceptance
By participating in the Deductify Affiliate Program, Affiliate acknowledges that they have read, understood, and agree to these Terms & Conditions.
16. Change of Control
Deductify reserves the right to modify, suspend, or terminate the Affiliate Program at any time, including in the event of a merger, acquisition, asset sale, or change of control of NDAS Inc.
Any accrued and unpaid commissions earned prior to such event will be paid in accordance with these Terms. Affiliates acknowledge that a successor or acquiring entity is not obligated to continue the Affiliate Program or assume any affiliate relationships unless expressly agreed to in writing.
